Terms of Service

1. Acceptance of Terms

Please read these Terms of Service (“Terms”) carefully before accessing or using CartRunner (the “Platform”), operated in Montevideo, Minnesota. By creating an account, browsing menus, placing an order, or registering as an independent delivery courier, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use our platform or services.

2. The CartRunner Delivery Platform

CartRunner is an on-demand logistics technology platform that connects customers with local food merchants (restaurants, cafes, bakeries) and retail supermarkets (e.g., Walmart Supercenter #1858 in Montevideo), and pairs them with independent third-party delivery couriers.

CartRunner provides dispatch coordination and payment processing services. While we enforce strict quality standards, preparation of restaurant items is the sole responsibility of the independent food preparation merchant.

3. Pricing, Fees & Payment Terms

  • Item Prices: Menu and retail item prices reflect merchant store prices plus applicable retail fulfillment markups or platform service fees clearly displayed in your order breakdown prior to checkout.
  • Delivery & Service Fees: Every order includes a transparent delivery fee based on mileage from the pickup merchant to your doorstep, plus a platform technology fee.
  • Driver Tips: 100% of customer tips are transferred directly to your delivery driver. Tips are non-refundable once an order is picked up.
  • Payment Authorization: When you place an order, your payment card is authorized through Stripe for the total order amount. If items are out of stock or cancelled, refunds or adjustments are issued back to the original payment method.

4. Order Placement, Modifications & Cancellations

  • Operating Hours: Orders may only be placed during active merchant kitchen and store operating hours.
  • Cancellation Window: You may cancel an order before a merchant begins cooking or before a courier begins shopping. Once food preparation has begun or a courier has departed with your order, cancellations may be subject to a cancellation fee to compensate the merchant and driver for incurred labor.
  • Auto-Timeout Protection: If no local couriers are available to accept an order within our dispatch window (typically 15 to 45 minutes), the order is automatically cancelled, and a 100% immediate refund is processed.

5. Independent Courier Terms & Standards

Drivers delivering through CartRunner are independent contractors (1099), not employees of CartRunner. Couriers choose their own shifts, accept offers freely, and maintain their own insured vehicles.

  • Background Checks: All couriers must submit to and pass a criminal background and motor vehicle record screening (via certified screening providers such as Checkr) prior to active dispatch.
  • Proof of Delivery: Drivers are required to capture a photographic Proof of Delivery (POD) for contactless door drop-offs verifying proper item placement.
  • Food Safety: Couriers agree to transport all food and temperature-sensitive grocery items safely and in accordance with Minnesota Department of Health standards.

6. Alcohol, Tobacco & Age-Restricted Goods

If ordering or delivering any age-restricted products, the recipient must present a valid government-issued photo ID verifying they are 21 years of age or older upon arrival. Couriers reserve the legal right to refuse delivery if valid ID is not provided or if the recipient appears intoxicated.

7. Disclaimers & Limitation of Liability

To the maximum extent permitted by Minnesota law, CartRunner is provided on an “AS IS” and “AS AVAILABLE” basis. CartRunner shall not be liable for indirect, incidental, special, or consequential damages resulting from restaurant preparation delays, merchant ingredient inaccuracies, severe weather disruptions in Chippewa County, or independent courier actions.

8. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any legal dispute, claim, or controversy arising out of these Terms shall be resolved in the state courts located in Chippewa County, Minnesota.
